Consumer fireworks are legal year-round during 9 AM – 10 PM at the state level per 8 MRS §223-A(8). However, municipalities may adopt ordinances to prohibit or restrict the sale or use of consumer fireworks within their boundaries per 8 MRS §223-A(2). Many Maine municipalities have enacted bans or restrictions. Municipalities must report restrictions to the Office of the State Fire Marshal within 60 days of adoption.
🎆 WHAT'S LEGAL IN MAINE?
Mortars, 500g cakes, aerial shells
Most 1.4G aerial consumer fireworks are legal, BUT missile-type rockets, helicopters/aerial spinners, and sky/bottle rockets are specifically banned. 8 MRS §221-A(1-A).
Fountains, cones, wheels, ground spinners
Sparklers, smoke bombs, snaps, poppers, snakes
Firecrackers, strings
Legal as consumer fireworks if meeting CPSC standards.
Spinning aerial devices
Helicopters and aerial spinners are specifically excluded from the definition of legal consumer fireworks. 8 MRS §221-A(1-A)(B).
Any DIY, altered, or reloaded fireworks
Illegal. Classified as 'fireworks' (not consumer fireworks) which are banned. Penalties include up to $1,000 fine and 6 months jail if value exceeds $100.
