Use outside legal windows is a Class 2 misdemeanor per SDCL 34-37-16.1. Counties may regulate or prohibit fireworks outside municipality boundaries when grassland fire danger is extreme under SDCL 34-37-19 (county regulations do not apply after Jul 2). Municipalities can limit or prohibit consumer fireworks use entirely.
