West Virginia legalized consumer fireworks (1.4G) in 2016. The state imposes no date or time restrictions on use. However, per WV Code §29-3E-10, municipalities may enact MORE restrictive ordinances, including date/time limits and proximity restrictions. For example, Mercer County limits discharge to Jun 24–Jul 7 and New Year's Eve/Day. Unincorporated areas follow state law only. A 12% fireworks safety fee is levied on all retail sales (§29-3E-7), distributed primarily to the Veterans' Facility Support Fund.
